Indiana's Democratic Senator Evan Bayh announced he will oppose Judge Roberts' confirmation to be chief justice:
"Advise and consent" must mean more than ascertaining collegiality and strength of resume. Those things are essential, but not enough. More important are a nominee's beliefs. On this score, in too many important areas, we can only speculate.

Regrettably, therefore, I cannot vote to confirm, not because I oppose John Roberts, but because we simply do not know enough about his views on critical issues to make a considered judgment. And that is the standard that must be met for a lifetime appointment to our nation's highest court.
The Democrats are making a huge mistake following Senator Schumer's misguided effort to raise the bar for judicial confirmations. There has been, nor can there be, certainty as to what a justice will do with any given case. Senator Bayh is wrong confirmation cannot be more than an act of faith.

I think that it is pretty evident why Bayh will vote against him, he is trying to put himself in the front seat (or at least be a passenger w/ Hillary) for the presidency. I think that a lot of Democrats will vote for this nominee leaving them some elbow room with the next nominee. However, I do think that Hillary will vote for him.
