New York Civil Liberties Union has appealed the court decision approving random police searches of riders' bags in New York's subway.
The appeal was filed with the 2nd U.S. Circuit Court of Appeals, challenging Judge Richard M. Berman's conclusion that the searches are constitutional.
Earlier this month, Judge Berman ruled that random police searches of subway riders' bags do not violate the Constitution and are a minimal intrusion on people's privacy.
As I have posted before, these suspicionless searches do little to deter any attack. Searches based on suspicious behavior would be more effective and less offensive to our right to be secure from unreasonable searches.
